Zip files and CD's are not refundable, but will be replaced for the same file or CD if found to be defective. All CD's are tested before being mailed.

My scrapbook kit items, templates and fill patterns may be used for your personal homepage, business or commercial WebPages newsletters, scrapbooks, letters, projects and much more. Be advised I retain the copyright to all of these images. By purchasing a CD or Zipped file, you are purchasing the right to use them, but they may not be altered or changed in any manner. In addition, my scrapbook kit items, templates and fill patterns may not be added to/or used for any graphics collections or award or greeting card collections (on or off line), The graphic files themselves may not be made available for download from any web page (either by themselves or in the form of tubes, pngs..etc.), may not be shared in newgroups, forums, or through email lists. (You may use the scrapbook kit items, templates and fill patterns on projects and in layouts and share those projects and/or layouts through email groups or on your website. If you so, a link to http://www.poundworks.com is required.)

Commercial use:

My scrapbook kit items, templates and fills may be used by small businesses ... people who make homemade or handmade crafts and gifts, homemade greeting cards, business cards, labels, gift bags, boxes... etc. Products or items created using a computer are considered hand-finished products for the purposes of this agreement. My scrapbook kit items, templates and fill patterns cannot be used on items, patterns or projects sold when mass produced. Large business owners may contact me regarding a written agreement of either royalties or a price per graphic that is used. Credit to PoundWorks is required on any item that is being sold using my scrapbook kit items, fill patterns or templates. No scrapbook kit item, template or fill pattern may be reproduced for mass marketing such as the gift industry or greeting card industry, or transmitted in any form or by any means, electronic or mechanical including photocopying, recording, or by any information storage and retrieval system, without my prior written permission

Commercial use requires credit given to me for scrapbook kit item, the artwork or template in the form of "Template by Gayle Pounds" either on the product itself or on a hang tag attached to the product or an insert card. You are free to make as may items as you wish as long as they are hand produced.

You may NOT grant, or warrant the royalty-free, perpetual, irrevocable, non-exlusive or fully sublicense rights or license to use, reproduce, adapt, modify, translate, publish, or create derivative works from my scrapbook kit items, templates or fill patterns to any other individual/party. Nor may you grant the right to any party to distribute or incorporate my templates or fill patterns in other works in any form, media or technology.

All my scrapbook kit items, templates and fill patterns are copyrighted 2003 Gayle Pounds and I maintain the full legal rights to my copyrighted designs at all times. My scrapbook kit items, templates and fill patterns are protected by international copyright laws.
